Purchases and Payments
All purchases made on the Website are subject to our pricing and payment terms.
- You agree to provide accurate payment information and authorize us to charge your chosen payment method for the agreed-upon amounts.
- Sales of web design and related services are conducted securely using Stripe.
- Payment terms: 50% upfront (non-refundable) and 50% upon completion of the project.
- Quotes are valid for 30 days from the date of issue.
- Late payments may result in work suspension, additional fees, or project delays.
Cancellation and Refunds
- No refunds will be issued once work on a project has commenced.
- The 50% upfront deposit is strictly non-refundable, as it covers initial planning, time allocation, and resource commitment.
- If a client becomes unresponsive for 30 days or more, the project may be deemed abandoned. All payments made up to that point will be retained.
Website Ownership
- All website source code, graphics, layouts, written content, design components, and related project files created by Tareeza Engineering LLC remain the exclusive property of Tareeza Engineering LLC unless a separate written Transfer of Ownership Agreement is signed by both parties.
- If a Transfer of Ownership Agreement is signed and full payment has been received, ownership rights for the final deliverables will be transferred to the client, excluding:
- Third-party licensed materials
- Stock images, fonts, or software requiring separate licensing
- Proprietary internal tools, frameworks, or code not specifically included in the agreement
- Until a Transfer of Ownership Agreement is executed, the client receives a license to use the website for its intended purpose, not ownership of its underlying files.
- We retain the right to display completed projects in our portfolio, marketing materials, and case studies unless otherwise agreed in writing.
Website Maintenance
- Because we build highly optimized websites using only HTML, CSS, and JavaScript—avoiding CMS platforms such as WordPress or Wix to ensure top performance—we strongly recommend purchasing a maintenance plan. If you require CMS capabilities for self-managed updates, this falls under our custom web design package.
- If you purchase a maintenance plan, we will perform updates, backups, monitoring, and general upkeep as described in your plan.
- Maintenance does not include major redesigns, custom feature development, or repairs due to third-party interference, hacking, or unauthorized edits. Maintenance covers standard content updates (text/images) and ongoing SEO upkeep.
- Clients without an active maintenance agreement are responsible for the security, updates, and ongoing functionality of their websites.
Client Responsibilities
Clients agree to:
- Provide all required content, materials, images, and information in a timely manner.
- Understand that professional copywriting services are available for an additional fee.
- Ensure that any content they supply does not infringe on copyrights, trademarks, or other intellectual property rights.
- Review drafts, mockups, and revisions promptly to avoid delays.
Failure to provide necessary content or timely feedback may extend project timelines.
Revisions and Scope Changes
- We use Figma to obtain design approvals for webpage layouts. Once a layout is approved, development begins. Any new change requests submitted after approval are considered additional revisions or scope changes.
- Additional revisions or major changes—such as added pages, new features, or significant design restructuring—will require additional fees and may extend the project timeline.
Third-Party Tools, Licenses, and Integrations
- Some projects may involve third-party software, plugins, fonts, or stock media.
- Clients are responsible for obtaining and maintaining any required third-party licenses unless otherwise stated in writing.
- We are not responsible for performance issues related to third-party services.
Disclaimer of Warranties
The Website and all associated content and services are provided “as is” and “as available” without warranties of any kind, whether express or implied.
We do not guarantee that the Website will be uninterrupted, secure, error-free, or free from harmful components.
Limitation of Liability
To the fullest extent permitted under Texas law:
- We are not liable for any indirect, incidental, punitive, or consequential damages arising from your use of the Website or our services.
- We are not responsible for losses due to hacking, server failure, third-party plugins, or client misuse.
- Our total liability shall not exceed the amount paid by you to Tareeza Engineering LLC for the specific project giving rise to the claim.
Termination
We may suspend or terminate your access to the Website at our sole discretion, without notice, if you violate these Terms or engage in unlawful activity.
